Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of ElevatEdu (the "Platform"), including any content, functionality, and services offered on or through elevatedu.org.

By registering for an account, accessing, or using the Platform, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

International Users:

Our services are available to users worldwide. By using our platform, you confirm that you are legally permitted to work in your country of residence and that your use complies with local laws.

User Accounts

To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use of your account
  • Not create multiple accounts for abusive purposes

Accounts are personal and non-transferable. You are responsible for all activities that occur under your account.

Job Seeker Responsibilities

As a job seeker using our platform, you agree to:

✓ Uploading CV/Resume

Ensure your CV/resume is accurate, up-to-date, and does not contain false or misleading information.

✓ Applying for Jobs

Only apply for positions you are genuinely interested in and qualified for. Do not submit fraudulent applications.

✓ Professional Conduct

Communicate professionally with employers. Harassment, spam, or abusive behavior will result in account termination.

✓ Data Accuracy

Provide truthful information about your qualifications, experience, and employment eligibility.

Prohibited Activities:

  • Applying for jobs on behalf of others without authorization
  • Submitting fake or misleading credentials
  • Circumventing employer application processes
  • Data scraping or automated application submissions

Employer Responsibilities

As an employer using our platform, you agree to:

Job Postings:

  • Post only legitimate job openings
  • Provide accurate job descriptions, including salary ranges where required by law
  • Clearly state employment terms (full-time, part-time, contract, etc.)
  • Comply with all applicable employment laws in your jurisdiction
  • Not post discriminatory job advertisements

Applicant Tracking System (ATS):

  • Use candidate data only for legitimate hiring purposes
  • Maintain confidentiality of applicant information
  • Comply with data protection regulations (GDPR, CCPA, etc.)
  • Respond to applicants within a reasonable timeframe
  • Delete candidate data when no longer needed for hiring purposes

International Hiring:

When hiring internationally, you are responsible for verifying work eligibility, understanding visa requirements, and complying with employment laws in the candidate's country of residence.

Content Guidelines

You are responsible for all content you upload, post, or transmit through the Platform:

  • Do not attempt to upload malicious files or viruses
  • Do not post discriminatory, harassing, or offensive content
  • Do not infringe on intellectual property rights
  • Do not post confidential or proprietary information of others
  • Do not use the Platform for illegal activities

We reserve the right to remove any content that violates these guidelines without prior notice.

Intellectual Property Rights

The ElevatEdu platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ElevatEdu, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

✓ You May:

  • Use the Platform for your personal or business hiring needs
  • Download and print job postings for your reference
  • Share job listings via provided sharing features
  • Use our ATS tools for legitimate hiring processes

✗ You May Not:

  • Copy, modify, or create derivative works of our platform
  • Use our trademarks, logos, or branding without permission
  • Scrape, crawl, or data mine our database of jobs or candidates
  • Reverse engineer, decompile, or disassemble any software

User Content License:

By uploading content (CVs, job postings, company information) to our platform, you grant ElevatEdu a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content for the purpose of operating and improving our services.

Termination

We reserve the right to terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to:

Grounds for Termination:

  • Violation of these Terms of Service or our Privacy Policy
  • Fraudulent, illegal, or abusive activity
  • Posting fake job listings or submitting fraudulent applications
  • Harassment of other users or platform staff
  • Circumventing platform fees or payment systems

Effects of Termination:

Immediate Access Loss

You will immediately lose access to your account and all platform features

Content Removal

We may delete your profile, job postings, applications, and uploaded documents

Financial Obligations

Outstanding payments remain due, and no refunds will be issued for terminated accounts

Note: You may terminate your account at any time by contacting our support team. Upon termination, we will retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law, ElevatEdu and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Errors, inaccuracies, or omissions in job listings or candidate profiles
  • Hiring decisions made by employers or acceptance decisions by job seekers
  • Unauthorized access to or alteration of your transmissions or data
  • Conduct of any third party on the Platform

Important Limitations:

Job Listings & Applications:

We are a platform connecting job seekers and employers. We do not guarantee the accuracy of job listings, the qualifications of candidates, or the outcome of any job application or hiring process.

Maximum Liability:

In no event shall ElevatEdu's total liability to you for all damages exceed the amount you have paid to ElevatEdu in the last 12 months, or one hundred dollars ($100), whichever is greater.

Jurisdictional Variations:

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. These limitations apply to the fullest extent permitted by law in your jurisdiction.

International Terms & Dispute Resolution

ElevatEdu operates as a global platform connecting users worldwide. Our company is registered in the People's Republic of China, while our services may be hosted in various jurisdictions to optimize performance for our international user base.

Primary Agreement Terms:

Choice of Law:

These Terms shall be interpreted and enforced in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions, except where mandatory local consumer protection laws in your jurisdiction provide otherwise.

Forum for Disputes:

Any disputes arising from these Terms shall be primarily resolved through negotiation and, if necessary, arbitration in Shanghai, China, in accordance with the Arbitration Rules of the China International Economic and Trade Arbitration Commission (CIETAC).

International User Protections:

European Union / EEA Users

EU consumers have the right to bring proceedings in their member state of residence under Regulation (EU) No 1215/2012. You may also use the European Commission's Online Dispute Resolution platform.

United Kingdom Users

UK consumers maintain protections under UK law and may bring proceedings in courts of England and Wales, Scotland, or Northern Ireland depending on residence.

ASEAN Region Users

For users in Singapore, Malaysia, Indonesia, and other ASEAN countries, we commit to good faith resolution respecting regional commercial practices.

Mandatory Local Laws

Nothing in these Terms overrides mandatory consumer protection laws of your country of residence that cannot be waived by agreement.

Class Action Waiver

Both parties waive the right to participate in class actions, class arbitrations, or representative actions. Disputes will be resolved individually only.

Hosting Location Notice

Our services may be hosted in various global locations (including Netherlands, Singapore, etc.) for performance optimization. Hosting location does not affect governing law or dispute resolution provisions.

Compliance Commitment: Regardless of these Terms, you remain responsible for complying with all applicable local laws regarding job seeking, employment, data protection, and online conduct in your jurisdiction. We strive to operate in compliance with international standards while respecting jurisdictional differences.
